4. Legal Guarantee Under EU Law

Consumers are entitled to a minimum 2-year legal guarantee for Goods that do not conform to the Contract.

The Company is liable for any lack of conformity that:

  • Exists at the time of delivery, and
  • Becomes apparent within 2 years from delivery

This legal guarantee applies automatically and free of charge.

Nothing in this Policy limits mandatory consumer rights.

5. Conformity Requirements

Goods must:

  • Correspond to the description provided on the Website
  • Be of the quantity and quality agreed
  • Be fit for the purposes for which goods of the same type are normally used
  • Possess the qualities and performance that are normal for goods of the same type

6. Burden of Proof

If a defect becomes apparent within:

1 year from delivery (or longer period if required by applicable national law), the defect is presumed to have existed at the time of delivery unless proven otherwise.

After this period, the burden of proof may shift to the Customer, as permitted by law.

7. Exclusions from Legal Guarantee

The legal guarantee does not apply where lack of conformity results from:

  • Normal wear and tear
  • Improper use
  • Failure to follow care instructions
  • Unauthorized repair or modification
  • Accidental damage
  • Deliberate damage
  • Improper storage
  • Use contrary to product purpose

For lingerie and swimwear, deterioration caused by:

  • Washing contrary to instructions
  • Exposure to chemicals (e.g., chlorine, detergents, perfumes)
  • Body oils, cosmetics, or external substances

may not constitute a manufacturing defect.

The Company reserves the right to assess each case individually.

8. Procedure for Reporting a Defect

If the Customer believes the Goods are defective, they must:

  • Notify the Company without undue delay after discovering the defect.
  • Provide: Order number, Description of the defect, Clear photographic evidence (where applicable).
  • Follow return instructions provided by the Company.

Failure to follow the prescribed return procedure may delay resolution.

9. Examination of Goods

Returned Goods will be inspected to determine:

  • Whether a lack of conformity exists
  • Whether the defect is manufacturing-related
  • Whether exclusion conditions apply

The Company may request additional information where necessary.

10. Remedies

Where a lack of conformity is confirmed, the Customer is entitled to:

  • Repair (where feasible), or
  • Replacement,

free of charge, including shipping costs.

If repair or replacement is:

  • Impossible,
  • Disproportionate, or
  • Not completed within a reasonable time,

the Customer may request:

  • A proportionate price reduction, or
  • Termination of the Contract (refund).

Refund may be refused where the lack of conformity is minor.

11. Refund Conditions

Where termination of the Contract is justified:

  • The Customer must return the Goods
  • Refund will be issued via the original payment method
  • Refund will be processed within 14 days after confirmation of defect and receipt of Goods

Refunds may be reduced proportionally if Goods were used beyond what is necessary to establish their nature, characteristics, and functioning.

12. Return Shipping Costs for Defective Goods

If lack of conformity is confirmed:

  • Return shipping costs will be reimbursed
  • Replacement shipping costs will be covered by the Company

If the defect is not confirmed:

  • The Company may charge return shipping costs
  • The Customer may be required to pay re-shipment costs

13. Commercial (Voluntary) Warranty

If the Company offers an additional commercial warranty:

  • It will be clearly described on the Website
  • It does not replace statutory legal guarantee rights
  • It applies only under the conditions explicitly stated

In absence of explicit written warranty, only the statutory legal guarantee applies.

The Company shall not be liable for failure or delay in performing its obligations due to events beyond its reasonable control, including but not limited to:

  • natural disasters,
  • governmental actions or restrictions,
  • war, civil unrest, or strikes,
  • cyberattacks or large-scale technical failures,
  • telecommunications or utility disruptions.

Performance of obligations shall be suspended for the duration of such event.

19. Severability and No Waiver

If any provision of this document is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

Failure by the Company to enforce any right or provision shall not constitute a waiver of such right or provision.

Nothing in this section limits statutory rights that cannot be excluded under applicable legislation.
